Secretary of State Marco Rubio ordered a freeze on all passports with “X” sex markers.
The State Dept. announcing through an internal cable that transgender and nonbinary Americans will no longer be allowed to use a sex marker on their passport applications.
“The policy of the United States is that an individual’s sex is not changeable,” read an email from Rubio that was obtained by The Guardian.
Rubio’s directive states that “sex, and not gender, shall be used” in official documents including passports and consular report of birth abroad documents.
The announcement came after the White House announced it would instruct the State Department and Department of Homeland Security, as well as other agencies to remove “nonbinary” or “other” options from federal documents, including passports and visas.
“No longer will the federal government be promoting gender ideology,” an incoming administration official told Politico.

LGBTQ Nation reports the first U.S. passport bearing an “X” gender marker was issued in October 2021. It followed a 2019 ruling by a federal judge saying that the U.S. had to issue a passport to Dana Zzyym — who identifies as intersex and non-binary.
“We’re going to look at what they actually do and when people’s rights are actually affected, then there will be lawsuits,” Lambda Legal chief legal officer Jennifer Pizer told NOTUS.
The order will not affect passports that have already been issued.
Trans and nonbinary people “can still apply to renew their passport — they just have to use their God-given sex, which was decided at birth,” White House Press Secretary Karoline Leavitt told NOTUS. “Thanks to President Trump, it is now the official policy of the federal government that there are only two sexes — male and female.”
