The Supreme Court allowed Title 42 border restrictions to remain in effect Tuesday in a blow to the Biden administration.
The court will hear a challenge from Republican-led states in February, Fox News reports.
Chief Justice John Roberts put a temporary hold on its termination. Justices Gorsuch and Jackson dissented, and both Justices Sotomayor and Kagan broke with the majority but didn’t write or sign a formal dissenting opinion.
Title 42, which allows the government to return illegal immigrants back to their home country, was expected to end today until the court’s order.
The restrictions were put in place by former President Donald Trump at the outset of the pandemic in 2020 but later reversed when Biden took office in 2021.
“With or without Title 42, let’s make no mistake, we’re already in the midst of the worst self-inflicted border security crisis in our lifetime,” former Border Patrol Commissioner Mark Morgan told Newsmax.
